If you are planning to start a business in Pennsylvania or already own one, then you need to know the legal requirements that come with it. Labour laws are an ever changing and complex world, and it is important for business owners to stay on top of them.
If you are planning on hiring legal minors, then you will need to follow Pennsylvania Child Labor laws. Another legal term business owners need to know about is FLSA or the Fair Labor Standards Act. This one concerns minimum wages, over time and recording of work hours. A poster showing FLSA needs to be displayed at a place where the employees can see it all times.
The next Law to follow is the Family and Medical Leave Act or FMLA. This law is all about employees taking leave for family related or medical reasons. This law protects the employees right to go on leave without having to fear termination. The employer does not need to pay the employee but they are entitled to 12 weeks of unpaid leave.
Age discrimination is not as common but it does happen to employees once in a while. That is why the Age Discrimination in Employment Act or ADEA was conceived. This law ensures that older employees get treated the same way as younger ones. ADEA is becoming an increasingly important one as the workforce ages.
Last but not least there is the taxman or the IRS. If the business is withholding income and social security tax from the employees, be very clear on the status of the employee. Independent contractors and part timers come under different rules. The IRS has very clear rules distinguishing different types of employees.
